1. Acceptance of Terms

By booking an appointment, using our on-site or mobile fingerprinting services, or otherwise engaging NVI Notarial Fingerprinting Services (“we,” “us,” “our”), you (“client,” “you”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Description of Services

We provide fingerprinting collection and submission services, including but not limited to:

• Digital fingerprinting (LiveScan)
• Ink fingerprinting
• FBI (FD-258) and RCMP (C-216C) fingerprint cards
• International fingerprinting and courier services
• Fingerprinting collection for record suspension (pardon) applications
• Fingerprinting collection for US Entry Waiver (Form I-192) applications
• Mobile/on-site fingerprinting for qualifying groups

We act solely as a fingerprinting collection and submission service. We are not a government agency, law firm, immigration consultancy, or pardon/waiver application service, and we do not determine eligibility, prepare applications, or guarantee outcomes for any government or third-party process.

3. Appointments & Booking

• Appointments may be booked online, by phone, or in person, subject to availability.
• You are responsible for arriving on time and bringing all required identification and documentation.
• Late arrivals may result in a shortened appointment, rescheduling, or forfeiture of your booking, at our discretion.
  
  

4. Fees & Payment

• Our standard service fee is C$69.99-C$79.99 per transaction, plus any applicable government fee, unless otherwise stated at time of booking.
• Government and third-party fees (e.g., RCMP processing fees) are set by the relevant agency and are subject to change without notice. We are not responsible for fee changes made by third parties.
• Payment is due at the time of service unless a corporate account or other billing arrangement has been agreed to in advance.
• All fees are quoted in Canadian dollars (CAD) unless otherwise specified.
  
  

5. Identification Requirements

You must provide valid, government-issued identification at the time of your appointment. We reserve the right to refuse service if identification is invalid, expired, or insufficient to complete your request. No refund will be issued in such cases if the appointment has already commenced.

6. Accuracy of Client-Provided Information

You are solely responsible for the accuracy and completeness of any personal information, forms, or documentation you provide to us, including the correct application type, purpose code, or destination agency. We are not liable for delays, rejections, or additional costs resulting from incorrect or incomplete information provided by you.

7. Processing, Submission & Turnaround Times

• Where applicable, fingerprints are submitted electronically through our RCMP-accredited system.
• Processing times for RCMP, FBI, or other government and international agencies are outside our control. We do not guarantee specific turnaround times for any third-party review or approval.
• For physical card submissions (e.g., FD-258, C-216C), you are responsible for confirming submission requirements with the receiving agency.
  
  

8. Mobile Fingerprinting Services

• Mobile/on-site appointments require a minimum group size of 10 people per booking.
• A minimum fee of C$800 applies if the confirmed group falls below the required minimum on the day of service, unless the appointment is rescheduled in accordance with our cancellation policy.
• Additional travel and on-site service fees apply and will be confirmed at the time of quote.
• Mobile service availability is subject to location, scheduling, and travel distance.
  
  

9. International Fingerprinting & Courier Services

• For fingerprints submitted to agencies outside Canada, you are responsible for confirming the specific format, card type, and documentation required by the receiving country or organization.
• Courier delivery timelines are provided by third-party couriers and are estimates only. We are not responsible for delays, loss, or damage caused by courier services once a package has left our custody, beyond what is covered by the courier’s own liability terms.
• Additional courier fees apply based on destination and service level selected.
  
  

10. Cancellations, No-Shows & Refunds

• Cancellations must be made at least 12 hours in advance.
• No-shows and late cancellations may be subject to a cancellation fee.
• Our service fee is generally non-refundable once an appointment has been completed and fingerprints have been captured, regardless of the outcome of any government or third-party review.
• Government and courier fees already paid to third parties are non-refundable once submitted.
  
  

11. No Legal, Immigration, or Application Advice

Our staff provide fingerprinting collection and submission services only. Nothing provided by us, verbally or in writing, constitutes legal advice, immigration advice, or a guarantee regarding the outcome of any application, waiver, pardon, visa, or background check. For questions regarding eligibility or application requirements, please consult a licensed lawyer, immigration consultant, or the relevant government agency directly.

12. Limitation of Liability

To the fullest extent permitted by law, [Business Name] is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to application delays, rejections, denied entry, denied licensing, or denied employment resulting from third-party decisions. Our total liability for any claim related to our services is limited to the amount paid to us for that specific transaction.

13. Privacy & Use of Personal Information

We collect personal information, including biometric fingerprint data, solely for the purpose of providing the requested service and submitting it to the relevant agency on your behalf. We do not sell your personal information. For more details, please see our [Privacy Policy].

14. Indemnification

You agree to indemnify and hold harmless [Business Name], its owners, employees, and affiliates from any claims, damages, or expenses arising from your misuse of our services, provision of false or misleading information, or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms and Conditions from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
